Your Bankruptcy Filing IS Public Record

     One piece of information bankruptcy attorneys should advise their clients is the fact, your bankruptcy filing is public information. I have this clause in my retainer agreement.

     In fact there is an internet site that list persons filing bankruptcy by city and state. However, this internet site is kind enough to offer to remove your name from this public list if you pay them $299.00.

     Worth it? In my opinion no!!!

     Once you file bankruptcy, most large banks have data mining software to determine who has filed bankruptcy for each day. It is no unusual for banks to know you filed bankruptcy before your attorney notifies you of the filing.

     All credit reporting bureaus know you filed bankruptcy and it is listed in your credit report.

     The information is readily available on the bankruptcy court’s website, provided you have registered, and have basic information as to whom you are trying to determine filed bankruptcy, the information is instantly available. On average of 2 or 3 times a month, I have clients come into the office who have filed a previous bankruptcy, and want to know if enough time has elapsed, thereby allowing them to file bankruptcy again. I can usually tell them within a minute if they can file again.

     Unfortunately, we live in the information age and the fact that you have filed bankruptcy is not something you can hide in the back corner of the closet anymore.
