A Bankruptcy Attorney’s Day at a 341a Hearing Today – July 9, 2010

Two items of note today:

1.) Some trustees will ask you at 341a hearing if you have ever used a different social security number. If the answer is yes,  you may have more issues to address.  You will have to file more paperwork with the court concerning the use of a different social security number and will have to notify the three credit reporting agencies.  If you used a different social security number and incur debt with that social security number, there may be more complications, as in some areas the United States Trustee’s Office investigates this issue, and may object to the discharge.

2.) While one debtor was testifying at the examination table, I noticed her attorney was looking at his email’s on his cell phone, and was not paying full attention to his client’s answers.  Your attorney has to pay careful  attention to the question being asked of his client.  The attorney’s client is usually very nervous at the hearing, and may very easily answer incorrectly.  Since the client is testifying under oath, the attorney may have make sure the client answers correctly.
