Today at the 341 Meeting of Creditors- a creditor showed up for the case called before mine.
The debtor had previously been a car dealer. The questioning included questions as to whether the debtor had a dealer’s license (if he had not had one, there could probably have been a case of misrepresentation if he had previously said he had one). Whether the debtor had owned a certain piece of property – he had, but had been foreclosed. Whether the debtor owned the land where he operated his dealership – no he leased the land. Whether the debtor had certain bank accounts. At one point, the debtor was getting to explain his answers, but his bankruptcy attorney correctly told him to be quiet and only answer the questions asked. That is good advice for anyone under oath, answer yes or no as much as possible, and only answer question asked without explanation. If not sure of question – don’t guess, ask for clarification.
