Frequently I am asked, “Will I be able to rent an apartment after I file bankruptcy?”
Well, since every apartment owner will have his own criteria for renting, I don’t think there is any one answer, but here are some factors to consider:
- Before forking over the $50 for a credit check, tell the apartment manager, you have filed bankruptcy, does that disqualify you completely from renting an apartment?
- Most apartment owners are aware that if you have had a recent bankruptcy, you can not file again for 8 years, and if you don’t pay your rent, they will be able to get a judgment and garnish wages.
- A few apartment owners that I have talked to, have indicated the bankruptcy by itself is not so damaging, and the one big RED FLAG- have you had a prior eviction.
- You might offer a bigger security deposit, or perhaps a co-signer.
One other consideration, Southern California is literally the bankruptcy capital of America. If landlords refused to rent to people who have filed bankruptcy, there would be a lot of vacant apartments.
