TELL THE TRUTH. When you appear at a 341a examination, you are sworn in, and you testify under oath. There is a big sign on the wall reminding you that “The FBI Investigates Bankruptcy Crimes.” The penalty for failure to testify can be either civil or criminal in nature. The civil penalty consist of denial of your discharge, leaving you responsible for your debt. The criminal penalty could be a jail sentence.

Many people wonder how will the bankruptcy trustee ever find out if I am lying.

Today, the trustee made an enlightening comment. The trustee said that he receives a great deal of information from ex boyfriends/girlfriend, ex spouses, ex business partners, and anyone who holds a grudge against you, and if this information is inconsistent with what the party filing bankruptcy disclosed, then don’t be surprise if you receive a call from you trustee asking for an explanation.
